AFRIVIO TERMS AND CONDITIONS

1. About these Terms
These Terms and Conditions govern access to and use of the Afrivio website, mobile application, platform, dashboards, services and related features.
Afrivio is a workforce technology product owned and operated by KTZ Holdings (Pty) Ltd, registration number 2021/614249/07, referred to in these Terms as “Afrivio,” “we,” “us” or “our.”
By creating an account, accessing the platform or using an Afrivio service, you confirm that you have read, understood and agreed to these Terms and our Privacy Notice.
If you do not agree, you must not create an account or use the platform.

3. What Afrivio provides
Afrivio is a workforce intelligence and project-matching platform that may enable:
Workers to create workforce profiles;
Students and graduates to create emerging-talent profiles;
Users to record pre-recorded AI-guided video interviews;
Employers to create projects containing multiple roles and headcounts;
Employers to identify and review potentially relevant candidates;
Employers to shortlist candidates and invite them to project roles;
Candidates to accept or decline project invitations;
Users to view workforce-readiness information;
Training providers to list courses, branches and services;
Occupational medical providers to list branches and services;
Employers and workers to find and book with relevant service providers; and
Afrivio to identify potential document, training or medical-readiness gaps.
Features may be introduced, changed, restricted or discontinued as the platform develops.
4. Afrivio is a platform
Afrivio facilitates connections between employers, workers, students, graduates and service providers.
Unless expressly agreed in writing:
Afrivio is not the employer of any worker;
Afrivio does not employ candidates on behalf of employers;
Afrivio is not a party to an employment contract concluded between an employer and candidate;
Afrivio does not control salaries, working hours, workplace conditions or employment decisions;
Afrivio is not a training institution;
Afrivio does not provide medical advice, examinations or diagnoses;
Afrivio does not guarantee employment, placement, bookings or project participation; and
Afrivio does not guarantee that an employer will fill any role.
Employers, candidates and providers remain responsible for their own decisions, agreements and legal obligations.
5. Eligibility
You must be at least 18 years old and legally capable of entering into an agreement to create an Afrivio account.
If Afrivio later permits users under the age of 18 to register, a separate consent and account process for a parent, guardian or other competent person may apply.
Organisations must be represented by a person authorised to act on their behalf.
6. Account registration
You agree to:
Provide complete and accurate information;
Keep your information current;
Create only one personal worker or student account unless Afrivio approves otherwise;
Keep your login details confidential;
Not allow another person to use your account;
Notify Afrivio if you suspect unauthorised access; and
Accept responsibility for activity conducted through your account.
Afrivio may request information necessary to confirm an account holder’s identity or authority to represent an organisation.
7. Worker, student and graduate profiles
Worker and emerging-talent profiles may include:
Name and profile photograph;
Skills and work experience;
Qualifications and field of study;
Trade, profession or occupation;
Current or general location;
Preferred work locations;
Availability;
Willingness to travel or relocate;
Employment preferences;
Submitted documents and credentials;
Workforce-readiness information; and
A pre-recorded AI-guided video interview.
You are responsible for ensuring that your profile is accurate and does not misrepresent your identity, qualifications, experience or abilities.
You must not submit false, altered, fraudulent, expired or misleading documents.
8. Profile visibility
When you consent to employer visibility, authorised potential employers may view the information made available through your workforce profile for recruitment, project matching and workforce-readiness purposes.
Your direct contact information may remain hidden until an authorised placement, invitation, introduction or “Add to Team” stage has been reached.
You may hide your profile from employer searches or request account closure using the available account settings or by contacting Afrivio.
Hiding a profile does not automatically remove information already lawfully accessed or retained by an employer for an active recruitment process.
9. AI-guided video interviews
Every worker, student or graduate required to complete an AI interview will be asked five questions related to the qualification, field of study, trade, industry or skill selected on the profile.
Each answer is limited to one minute.
The answers are recorded and stored as a pre-recorded video interview forming part of the user’s Afrivio profile.
Before recording begins, the user must separately consent to:
The recording of their image and voice;
Storage of the recorded interview;
Inclusion of the interview on their profile; and
Viewing of the interview by authorised potential employers for recruitment purposes.
The AI interview is intended to help the user demonstrate knowledge and help employers conduct initial screening.
The interview:
Does not guarantee employment;
Does not independently verify qualifications;
Does not prove technical competence;
Does not replace a trade test or practical assessment;
Does not replace reference or background checks;
Does not make the final hiring decision; and
Must not be treated as the sole basis for an unlawful or discriminatory decision.
Employers remain responsible for reviewing the candidate fairly and conducting any additional assessment required for the role.
10. Matching and readiness scores
Afrivio may use profile and project information to identify potentially relevant matches.
Matching may consider:
Skills and qualifications;
Relevant experience;
Role requirements;
Location and proximity;
Availability;
Travel or relocation preferences;
Submitted credentials;
Training requirements;
Occupational medical requirements; and
Other project-readiness information.
A match, ranking, recommendation or readiness score is an informational tool. It is not a guarantee that the candidate is suitable, qualified, verified, employable or available.
Employers must conduct their own due diligence before making an employment or placement decision.
11. Documents and verification status
Afrivio may allow users to upload or record qualifications, certificates, licences, registrations and other documents.
Unless a document is clearly marked as verified, it must be treated only as submitted.
Afrivio does not guarantee the authenticity, accuracy, validity or current status of a submitted document.
Employers remain responsible for verifying:
Identity;
Qualifications;
Trade certificates;
Licences;
Professional registrations;
Employment history;
References;
Background information; and
Any other role-specific requirement.
Users authorise Afrivio to update the status of a document if verification becomes available through an authorised institution or verification service.
12. Medical information
Medical results, diagnoses, medical history, test values and clinical information are not displayed to potential employers through a standard Afrivio profile.
Employers may only see limited project-readiness statuses, such as:
Occupational medical required;
Medical requirement outstanding;
Appointment booked; or
Medical document submitted.
A medical status shown on Afrivio is not medical advice and does not guarantee that a person is medically fit for a specific role.
Any medical examination, finding, certificate or professional decision remains the responsibility of the appropriately qualified medical provider.
Where a user books with a medical provider through Afrivio, Afrivio may share the minimum contact and appointment information required to process the booking. Medical results must not be shared with potential employers through the ordinary booking process.
13. Employers
Employers agree to:
Provide accurate organisation and project information;
Post only genuine opportunities and projects;
Describe roles and requirements fairly;
Use candidate information only for lawful recruitment and workforce planning;
Protect candidate information from unauthorised access;
Not contact, harass or discriminate against candidates unlawfully;
Verify candidates and documents before appointment;
Comply with employment, labour, equality, health and safety, immigration and industry requirements;
Make final recruitment decisions using appropriate human judgement; and
Delete or securely retain candidate information in accordance with applicable law.
Employers must not use Afrivio data to create unrelated marketing lists, resell personal information, conduct unauthorised surveillance or make unlawful discriminatory decisions.
14. Project invitations and placements
An employer may invite a candidate to a project role through Afrivio.
A candidate may accept or decline the invitation.
An invitation, acceptance, match or addition to a project team does not by itself create an employment relationship or employment contract.
The employer and candidate are responsible for agreeing on:
Compensation;
Employment status;
Start and end dates;
Working hours;
Duties;
Workplace rules;
Benefits;
Accommodation;
Transport;
Health and safety requirements; and
Any other employment condition.
15. Free placement and employer packages
Afrivio may offer an employer one qualifying placement at no charge, subject to the offer displayed on the platform at the relevant time.
Afrivio may require an employer package, subscription or top-up for additional placements, team members or platform features.
The applicable price, duration, included features and placement limits will be displayed before purchase.
A free placement:
Is limited to the applicable trial conditions;
Is not transferable between unrelated employer accounts;
May not be used repeatedly through duplicate accounts; and
May be withdrawn where misuse or fraud is suspected.
16. Fees and payment
Worker, student and graduate access to employment matching and placement services will not be charged where prohibited by applicable employment-services law.
Separate third-party services, including training courses or occupational medical services, may carry fees charged by the relevant provider.
Employers and providers may be charged for packages, subscriptions, listings, placements, bookings or other services as displayed before purchase.
All prices must be stated in South African rand unless indicated otherwise.
The user is responsible for applicable taxes and approved payment charges.
Afrivio may use authorised third-party payment providers. Afrivio does not retain full payment-card details unless expressly stated.
17. Renewals, cancellation and refunds
The applicable package page or order confirmation will state whether a service is once-off, recurring or fixed-term.
Users may cancel recurring services through the available account settings or by contacting Afrivio.
Cancellation does not automatically entitle the user to a refund for services already delivered, placements already completed or periods already used.
Any cancellation charge, refund or cooling-off right will be applied in accordance with applicable consumer law and the package terms shown before purchase.
Nothing in these Terms removes a right that cannot lawfully be excluded under the Consumer Protection Act or other applicable law.
18. Training providers
Training providers agree to:
Provide accurate organisational and course information;
State any accreditation or registration accurately;
Not claim accreditation they do not hold;
Keep course dates, locations, fees and availability current;
Deliver booked services professionally and lawfully;
Issue only authentic records or certificates; and
Comply with applicable education, skills-development and industry requirements.
Afrivio does not guarantee a provider’s accreditation, service quality, availability or suitability unless expressly stated as verified.
Registration on Afrivio does not guarantee bookings or revenue.
19. Occupational medical providers
Occupational medical providers agree to:
Be appropriately registered and authorised;
Provide accurate information about services and branches;
Protect medical and personal information;
Obtain any legally required consent;
Keep clinical information confidential;
Conduct assessments professionally and independently; and
Comply with applicable health-profession and data-protection requirements.
Afrivio does not influence or determine a medical result.
20. Bookings with service providers
Afrivio may facilitate bookings between users and independent training or medical providers.
The provider remains responsible for:
Service delivery;
Professional quality;
Pricing;
Availability;
Rescheduling;
Cancellation;
Certificates or reports; and
Any refund owed for the provider’s service.
Afrivio may assist with communication but is not responsible for a provider’s professional decision or failure to deliver unless Afrivio expressly accepted that responsibility in writing.
21. Fair recruitment and prohibited discrimination
Employers must use Afrivio in accordance with the Employment Equity Act and other applicable equality and labour laws.
Candidate information, video interviews, matching results and readiness indicators must not be used for unlawful discrimination.
Afrivio may suspend an employer where there is credible evidence of discriminatory, fraudulent, exploitative or unlawful conduct.
22. Acceptable use
You must not:
Create a false identity or organisation;
Submit fraudulent credentials;
Misrepresent an opportunity;
Scrape or copy profiles in bulk;
Sell or disclose personal information;
Bypass account or payment controls;
Introduce malicious software;
Attempt unauthorised access;
Reverse engineer the platform except where legally permitted;
Harass another user;
Publish unlawful or harmful content;
Use the platform for trafficking, forced labour or exploitation; or
Use Afrivio for any unlawful purpose.
23. User content
You retain ownership of information, documents and recordings you lawfully submit.
You grant Afrivio a limited, non-exclusive licence to host, store, process, reproduce and display that content only as necessary to operate, secure and improve the platform and provide the services you requested.
You confirm that you have the right to submit the content and that it does not unlawfully infringe another person’s rights.
24. Afrivio intellectual property
Afrivio and its licensors own the platform, software, design, trademarks, branding, databases, workflows and original content, excluding user-owned content.
You may not copy, reproduce, modify, sell, license or commercially exploit Afrivio intellectual property without written permission.
25. Third-party services
Afrivio may use or link to independent services, including payment processors, hosting providers, verification services, maps, communication services and service-provider websites.
Third-party services may have their own terms and privacy notices.
Afrivio is not responsible for an independent third party’s service, content or availability, except to the extent required by law.
26. Platform availability
Afrivio aims to provide a reliable platform but does not guarantee uninterrupted or error-free availability.
Access may be interrupted for maintenance, security, upgrades, network failures or circumstances beyond Afrivio’s reasonable control.
Afrivio may change or improve features without materially removing paid benefits during an active paid period, except where necessary for security, law or platform integrity.
27. Suspension and termination
Afrivio may restrict, suspend or terminate an account where:
These Terms are breached;
Fraud or identity misuse is suspected;
False documents are submitted;
Candidate information is misused;
Fees remain unpaid;
Platform security is threatened;
Another person’s rights are infringed; or
Suspension is reasonably required by law.
Where reasonably possible, Afrivio will provide notice and an opportunity to respond.
Users may close their accounts through available settings or by contacting Afrivio.
Personal information will be handled after closure in accordance with the Privacy Notice and applicable retention requirements.
28. Disclaimer of guarantees
Afrivio does not guarantee:
Employment or placement;
A minimum number of candidates;
A minimum number of opportunities;
Candidate suitability;
Employer legitimacy beyond checks expressly performed;
Document authenticity unless marked verified;
Provider bookings;
Training outcomes;
Medical outcomes;
Platform revenue; or
Project success.
29. Limitation of liability
To the maximum extent permitted by law, Afrivio will not be liable for indirect, incidental, special or consequential losses arising from:
An employment or recruitment decision;
False information supplied by a user;
An employer-candidate dispute;
A provider’s service or professional decision;
Loss of opportunity;
Unauthorised conduct outside Afrivio’s reasonable control; or
Temporary platform unavailability.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including rights under applicable consumer-protection law.
30. Complaints and disputes
Users should first submit complaints to:

Afrivio will attempt to investigate and resolve the complaint reasonably.
If a dispute cannot be resolved directly, the parties may use an appropriate regulator, ombud, mediation process or court with jurisdiction.
31. Changes to these Terms
Afrivio may update these Terms when its services, technology or legal obligations change.
Material changes will be communicated through the platform, by email or by another reasonable method.
Continued use after the effective date of updated Terms constitutes acceptance, subject to any additional consent required by law.
32. Governing law
These Terms are governed by the laws of the Republic of South Africa.
South African courts will have jurisdiction, subject to any right to approach a regulator, tribunal, ombud or other competent body.
33. General
If a provision is found invalid or unenforceable, the remaining provisions continue to apply.
Afrivio’s failure to enforce a provision immediately does not waive its rights.
These Terms, the Privacy Notice, the applicable package terms and any confirmed order form the agreement between Afrivio and the user concerning the platform.
